1. EA TUNING ESSENTIALS TERMS OF SERVICE
Please read through these terms carefully and thoroughly. By booking an appointment with EA Tuning Essentials, you agree to comply with these terms and conditions. These terms outline the obligations and responsibilities of both parties and provide important information about our services, policies, and warranties.
2. DEFINITIONS
EA Tuning Essentials: EA Tuning Essentials is a company specializing in vehicle tuning and dyno testing services. They offer a range of services including power runs, dyno sessions, and related procedures to enhance vehicle performance and diagnostics.
Customer: Any person or entity who engages the services of EA Tuning Essentials.
Service: Any tuning, diagnostics, or other services provided by EA Tuning Essentials.
Maintenance Confirmation: Customer’s confirmation that the vehicle’s maintenance is up-to-date according to the manufacturer’s specifications.
Roadworthy Condition: The requirement that the vehicle is properly taxed, has a valid MOT certificate, and all critical systems (brakes, tires, lights) are in good working order.
Risk Acknowledgement: The customer’s acceptance that tuning services are carried out at their own risk, and EA Tuning Essentials is not responsible for failures, damages, or malfunctions.
Pre-Test Conditions: Requirements for verifying the vehicle’s optimal condition before testing (e.g., topping up fluids, checking tires and cooling system).
Safety: Customer’s obligation to adhere to all safety instructions provided by EA Tuning Essentials.
Liability Prevention and Limitation: Disclaimer of liability for mechanical failures and no warranty for wear-prone parts or modified components.
Indemnification Clause: Customer agrees to indemnify and hold EA Tuning Essentials harmless from any claims, damages, liabilities, costs, and expenses arising from the use of services.
3. VEHICLE CONDITION AND YOUR RESPONSIBILITY
3.1. Maintenance Confirmation
It is imperative that you ensure your vehicle’s maintenance is up-to-date and adheres to the manufacturer’s specifications. Regular maintenance includes but is not limited to oil changes, fluid checks, and timely replacement of wear-and-tear parts. By bringing your vehicle to EA Tuning Essentials, you confirm that all necessary maintenance has been performed and that the vehicle is in optimal condition for tuning.
3.2. Roadworthy Condition
Your vehicle must be in a roadworthy condition to undergo any tuning or testing procedures. This includes, but is not limited to, the vehicle being properly taxed and having a valid MOT certificate. All critical systems such as brakes, tires, and lights should be in good working order. By proceeding with our services, you confirm that your vehicle meets these roadworthiness criteria.
3.3. Risk Acknowledgement
By opting for tuning services at EA Tuning Essentials, you acknowledge and accept that these services are carried out at your own risk. EA Tuning Essentials shall not be held responsible for any failures, damages, or malfunctions that may occur during or after the tuning process. This includes any issues that may arise due to pre-existing conditions or inadequate maintenance.
3.4. ECU Software Warranty
EA Tuning Essentials provides a lifetime warranty on the ECU (Engine Control Unit) software only. This warranty ensures that the software modifications we apply will remain functional and free from defects for the life of the vehicle. However, this warranty does not cover any hardware components or mechanical failures that may occur, nor does it cover any issues arising from subsequent modifications or tuning by third parties.
4. MECHANICAL FAILURES AND WARRANTY
4.1. Exclusions
It is important to note that certain wear-prone components are excluded from any form of warranty provided by EA Tuning Essentials. These components include, but are not limited to:
Clutch
Diesel Particulate Filter (DPF)
Turbocharger
Boost Hoses
Intercoolers
Gearboxes
These parts are subject to regular wear and tear and are not covered under our warranty policies. Customers should ensure these components are in good working condition prior to any tuning services.
4.2. Liability Disclaimer
EA Tuning Essentials explicitly states that we do not accept liability for any mechanical failures that may occur before, during, or after the tuning process. This includes, but is not limited to, any breakdowns, malfunctions, or damages that arise as a result of the tuning or as a consequence of pre-existing conditions in the vehicle. The responsibility for ensuring the vehicle’s readiness and suitability for tuning lies solely with the customer.
4.3. Modified Components
Any vehicle components that have been previously modified or altered from their original specifications are not covered under any warranty provided by EA Tuning Essentials. This includes aftermarket parts or any modifications done by other tuning services. Customers are advised that the presence of such modifications can impact the performance and reliability of the vehicle and that EA Tuning Essentials cannot guarantee the efficacy of our tuning services on vehicles with non-standard components.
5. REMAPPING PROCESS RISKS
5.1. Health Check Requirement
Prior to undergoing any remapping services, it is strongly recommended that a comprehensive health check of your vehicle is performed. Opting to proceed with remapping without such a health check is done entirely at your own risk. A thorough health check helps ensure that all systems are functioning correctly and can handle the changes that remapping will introduce. This step is crucial for identifying any pre-existing issues that could be exacerbated by the remapping process.
5.2. Warranty Limitation
The warranty provided by EA Tuning Essentials is strictly limited to the ECU (Engine Control Unit) software. No implied or explicit warranty is provided for any other components of your vehicle. This limitation means that any issues or failures in parts other than the ECU software, whether arising immediately after the remap or at a later date, will not be covered under our warranty. Customers should be aware of this limitation and plan accordingly.
5.3. Responsibility for Vehicle State
As the vehicle owner, you bear full responsibility for ensuring that your vehicle is in a suitable condition for remapping. This includes, but is not limited to, verifying that all mechanical and electrical systems are in good working order. Any pre-existing issues with the vehicle should be addressed and rectified prior to the remapping process. EA Tuning Essentials will not be held accountable for any adverse outcomes resulting from the remapping of a vehicle that is not in optimal condition.
5.4. Additional Risks and Considerations
Pre-existing Conditions: Any underlying issues not identified before the remapping process may become more pronounced after the remap. It is the customer’s responsibility to disclose any known issues with the vehicle.
Performance Variability: The performance enhancements achieved through remapping can vary depending on the overall health and condition of the vehicle. Identical vehicles may exhibit different performance results post-remap due to differences in maintenance and existing wear and tear.
Component Stress: The increased performance demands on the vehicle post-remap can place additional stress on various components. It is important to consider the potential for accelerated wear and to monitor vehicle health regularly following a remap.
6. CUSTOMER AWARENESS
6.1. Vehicle History
EA Tuning Essentials does not possess any prior knowledge or records regarding the history, maintenance, or modifications of your vehicle. It is important for the customer to provide comprehensive and accurate information about the vehicle’s background, including any past repairs, modifications, or maintenance schedules. This information is crucial for us to understand the current state of the vehicle and to perform the tuning process effectively.
6.2. Undetected Issues
It is the customer’s responsibility to disclose any known issues or concerns about the vehicle before the remap process begins. While we conduct a pre-health check to identify potential problems, certain issues may not be detected during this check. Any problems that go unreported or unnoticed prior to the remapping will remain the responsibility of the customer. It is crucial to address any pre-existing conditions before proceeding with the remap to avoid complications.
6.3. Damage Acceptance
By agreeing to the remap process, you acknowledge and accept the risk of potential damage to serviceable parts before, during, and after the tuning. This includes, but is not limited to, components such as the engine, transmission, and other mechanical or electronic systems. EA Tuning Essentials is not liable for any damage that may occur as a result of pre-existing conditions, undisclosed issues, or the remapping process itself.
6.4. Additional Considerations
Transparency: We encourage open communication and transparency regarding any concerns or questions you may have about the remap process. Providing us with detailed information about your vehicle helps ensure the best possible outcome.
Maintenance and Inspection: Regular maintenance and inspection of your vehicle post-remap are essential. The enhanced performance may place additional stress on certain components, and it is important to monitor and address any emerging issues promptly.
Performance Variations: Understand that performance gains from remapping can vary based on the individual condition of your vehicle. Identical vehicles can exhibit different results due to variations in wear and tear, maintenance, and other factors.
7. DEPOSIT AND CANCELLATION POLICY
This policy applies to all of our services. To secure your appointment, a non-refundable deposit may be required at the time of booking. This deposit guarantees your slot and covers the preliminary preparations for your tuning session.
If you need to cancel your appointment, please provide at least 24 hours’ notice. Failure to do so, or if you do not reschedule, will result in the forfeiture of your deposit. Additionally, if your vehicle cannot be tuned due to pre-existing faults or because it has been previously tuned, the deposit will not be refunded. In situations where no deposit has been taken and your vehicle is deemed untunable for these reasons, a charge of £50 will apply, which is equivalent to the standard deposit.
8. WARRANTY OF SERVICES POLICY
Our commitment to quality is reflected in our lifetime warranty on all software provided by EA Tuning Essentials. This warranty includes free diagnostic scans and any necessary adjustments to the tuning map. For warranty services, you may bring your vehicle to our facility. If you prefer that we come to you, additional fees may apply based on the distance and nature of the service required.
8.1. Applicability of Warranty Policy
The warranty is specific to the vehicle and does not transfer to new owners in the event of a sale.
To validate your warranty, proof of purchase (receipt) is required. Failure to present this documentation may result in additional charges.
If diagnostics reveal faults unrelated to our tuning software, a diagnostic fee of £50 will be charged.
The warranty will be voided if the vehicle is serviced or tuned by another tuner or garage, as this may result in alterations to our software.
8.2. Money Back Guarantee
We stand by the quality of our software with a comprehensive money-back guarantee. If there is a fault with the software that cannot be rectified, we will offer a full refund. To qualify, the vehicle must be returned to us, giving us the opportunity to correct the issue or restore the vehicle to its original state. Refunds will not be issued if it is proven that the fault is unrelated to our software. Please note that EA Tuning Essentials is not responsible for any mechanical part failures that may occur.
9. GENERAL DISCLAIMER
All procedures, tests, and disclaimers apply to EA Tuning Essentials. Please read this document carefully and sign the agreement below. No tests will be conducted without a signed agreement to these terms and conditions.
10. TESTING AND SAFETY PROCEDURES
EA Tuning Essentials conducts thorough power testing on the road to determine your vehicle’s performance metrics. This method allows us to evaluate your vehicle’s performance under real-world conditions, considering factors such as actual loads, wind resistance, and the natural transfer of weight between axles. Moreover, during these sessions, we may monitor boost levels, fuelling using a wideband lambda sensor, and knock detection where possible. Our comprehensive testing also includes checks on the ignition operation, fuelling system, engine management fault codes, and live data, with necessary adjustments made where possible.
11. PRE-TEST CONDITIONS
To ensure accurate and safe testing, the customer must verify that the vehicle is in optimal condition. This includes:
Topping up fluid levels (oil, water).
Ensuring tyres are in good condition and properly inflated.
Confirming the cooling system is free from defects and functioning correctly.
Ensuring the exhaust system is gas-tight to prevent dilution of readings.
Having an adequate level of the fuel type normally used, especially for mapping sessions.
All relevant components, such as spark plugs, injectors, turbochargers, and the ignition system, should be in sound condition for accurate performance testing. Our road tests can also help identify any problems with the vehicle.
12. REAL-WORLD ROAD TESTING
EA Tuning Essentials is committed to providing accurate and comprehensive vehicle assessments through real-world road testing. Unlike controlled environments, our road testing ensures your vehicle is evaluated under everyday driving conditions. This method allows us to measure performance metrics such as BHP and torque while the vehicle is subjected to actual loads, wind resistance, and the natural transfer of weight between axles. By simulating the variables your car encounters on a daily basis, we can offer a more precise tuning experience, ensuring that your vehicle performs optimally in real-life scenarios.
13. HANDLING UNEXPECTED ISSUES DURING PROGRAMMING
In the rare event that an issue arises during the programming of your vehicle, EA Tuning Essentials will make every effort to resolve it as quickly as possible. However, some situations may require the involvement of external repair companies, which can lead to unpredictable repair times. Should this occur, any costs incurred by the customer for travel arrangements or other expenses due to the temporary loss of the vehicle will be the customer’s responsibility. We appreciate your understanding and cooperation in such circumstances.
14. SAFETY
Customers must adhere to all safety instructions provided by EA Tuning Essentials. Failure to follow safety instructions will result in the immediate cessation of testing.
15. LIABILITY PREVENTION AND LIMITATION
Disclaimer: EA Tuning Essentials disclaims all liability for mechanical failures before, during, or after the tuning process.
Component Warranty: No warranty is offered for wear-prone parts such as the clutch, DPF, turbo, boost hoses, intercoolers, gearboxes, or any modified components.
16. INDEMNIFICATION
You agree to indemnify and hold EA Tuning Essentials harmless from any claims, damages, liabilities, costs, and expenses arising from your use of our services, including any damage to your vehicle or our equipment.
17. CUSTOMER AGREEMENT
By proceeding with the services provided by EA Tuning Essentials, you acknowledge and accept the inherent risks involved, including those outlined above. You also agree to hold EA Tuning Essentials harmless for any issues arising from pre-existing conditions or the general state of your vehicle at the time of the remap.
